Wrongful Death

Wrongful death is a legal term that refers to situations where someone is fatally injured due to the negligence, recklessness or intentional acts of another person or entity. Wrongful death actions may arise from motorcycle or automobile accidents, medical malpractice, airplane crashes, accidents in the workplace, nursing home abuse or neglect, malfunctioning or defective products or other situations where someone is killed due to the negligence of another.

The primary purpose of the wrongful death statute is to provide compensation to the injured parties for the wrongful death of a loved one. Filing suit against those responsible will punish them for their negligent actions and act as a deterrent against future negligent acts. Wrongful death actions have helped to provide consumers with, among other things, safer cars, safer foods, safer products and less pollution.

A plaintiff in a wrongful death action may be able to recover damages such as medical and funeral expenses, the loss of the deceased's earnings and earning capacity, loss of pension benefits, loss of insurance benefits, pain and suffering, mental anguish, and the loss of care, protection and companionship to the survivors.

The emotional and monetary losses suffered by a family can be devastating following the wrongful death of a loved one. It is important to speak with an attorney familiar with Florida law if you have suffered as a result of the wrongful death of a loved one due to the negligence of another.
